Moodie upsets Ancic to win Japan Open title

Tokyo: Underdog Wesley Moodie stormed back from the brink of defeat to beat Mario Ancic of Croatia for his first career title at the Japan Open tennis tournament on Sunday.


The unseeded South African, who saved four match points to win the semifinals on Saturday, staved off another two in the second-set tie-breaker before scoring a stunning 1-6, 7-6 (9/7), 6-4 victory.

"It feels great to win my first title, especially being match points down in the semis and the finals. I was fortunate to come back and playing well. It's an amazing feeling," said Moodie.

The women's singles final was won by Nicole Vaidisova of the Czech Republic after Tatiana Golovin of France abandoned it due to a left foot injury at 7-6 (7/4), 3-2 and 30-15.

Croatia beats Sweden to secure a berth in 2006 FIFA World Cup

Croatia beat Sweden 1-0 on Saturday evening with the help of a penalty, to secure a berth in the 2006 FIFA World Cup finals, said reports from the Croatian capital of Zagreb.

The decisive moments for Croatia came in the 56th minute when Sweden captain Olof Mellberg handled in the area and Darijo Srna of Croatia kept his cool from the spot to decide a tightly contested match.

Croatia moved above Sweden atop Group 8 with 23 points and are sure to either top the group or finish as one of Europe's two best-placed runners-up.

Eight group winners advance to the World Cup finals as well as the two best runners-up. The other runners-up playoff for another three places.

The win on Saturday evening sees Croatia continue their record of qualifying for all three World Cups they have entered since its independence in 1991.

Sweden, who were without Juventus star Zlatan Ibrahimovic because of a knee injury, can still secure a place in the World Cup finals with a home victory over Iceland in the final qualifying match on Wednesday, when Croatia face Hungary in Budapest.

Deliberate human rights violations againstCroatia

Dear All,

All this (below) has to be in ENGLISH as the whole delPonte AGGRESSION
is evidently AGAINST even the most elementary human rights ...

I (we) would (re)act in the same way if somebody arrested a journalist
from (say) Senegal or Canada ... especially as ALL THE INFO was
published BEFORE on the Internet ... so this is a clear political farse !
(you can read various Croatian testimonies below).

Last but not least - we should INDICT del Ponte as a group of citizens
(say) in the USA or Switzerland. Do not tell me it is not possible.
All we need is ONE decent honest and qualified lawyer.

All our organizations and all NORMAL people I contacted - AGREE !

IDel Ponte is clearly BigBrother aggression against elementary human rights
she even knows FACTS ...

Splitski novinari izrazili podrsku Jovicu
Objavljeno prije sat vremena

TRIDESETAK splitskih novinara iz svih redakcija
i dopisnistava te kulturnih djelatnika okupilo
se danas na splitskom Narodnom trgu kako bi dali
potporu novinaru Josipu Jovicu i izrazili
negodovanje zbog njegova, kako su ocijenili,
jucerasnjega nepotrebnog privodjenja i
zadržavanja u zatvoru na Bilicama.

Mladen Vukovic, urednik kulture na Hrvatskom
radiju, obracajuci se okupljenim kolegama
novinarima, kazao je kako se "nakon zastare od
sedam, osam godina, nakon sto su svjedocenje
zasticenog svjedoka objavili gotovo svi mediji,
sada proganja novinar koji je zbog svojih napisa
i zalaganja za slobodu javne rijeci dva puta
dobio novinarsku nagradu Zlatno pero".

Vukovic je pozvao haasko i hrvatsko pravosudje da
ne bude selektivno te da uoci Dana hrvatske
neovisnosti, 8. listopada, posvjedoci kako je u
trodiobi vlasti sudstvo doista neovisno.

Predsjednik Matice hrvatske u Splitu Josip
Botteri rekao je da je zgrožen, dodavsi da se "u
novoj Hrvatskoj ne pamti takav progon pisane
rijeci i to", kako je kazao, "u Marulicevu gradu
koji je uvijek bio slobodarski".

Pjesnikinja i novinarka djurdjica Ivanisevic
podsjetila je na trend u cijelom svijetu da se
energicnije zastite svi pisci bez obzira na
svjetonazor i misljenje.

Podsjetila je na slucaj poznatoga turskog pisca
Orhana Pamuka, zbog kojega se digla velika bura
u Turskoj iako je, kako je rekla, ta zemlja
dobila zeleno svjetlo za pocetak pregovora za
ulazak u Europsku uniju.

Novinari su se na danasnjem okupljanju na
splitskom Narodnom trgu simbolicno vezali
lancima, a istaknute su i poruke, medju kojima:
"I ja sam Josip Jovic", "Jozef K. jednako Josip
Jovic" aludirajuci na Kafkin roman, "Branitelji
Helene Puljiz - javite se", "Tužitelji - sretan
vam Dan neovisnosti".

Inace, u splitsko dopisnistvo Hine od jutros
stižu tekstovi potpore Josipu Jovicu od
razlicitih stranaka i udruga, medju kojima
Hrvatske bratske zajednice u SAD-u, Hrvatskog
bloka, Hrvatske ciste stranke prava,
braniteljskih udruga prosteklih iz Domovinskog
rata.

Takodjer Stranka demokratske akcije Hrvatske
(SDAH) u priopcenju je "izrazila svoje
nezadovoljstvo zbog uhicenja novinara Slobodne
Dalmacije Josipa Jovica". U priopcenju se istice
kako "uhicenje novinara proizvodi nesigurnost te
struke, a u konacnici to znaci pokusaj
suspenzije demokratskih nacela i demokracije".

SDA Hrvatske takodjer navodi kako se "pridružuje
prosvjedima demokratske javnosti" zbog ovakvog
postupanja prema novinaru Josipu Jovicu te
"izražava nadu da cemo uskoro toga novinara
vidjeti na slobodi".

Muljacic odbacio spekulacije o izrucenju Jovica

Pomocnik ministrice pravosudja Jaska Muljacic
odbacio je u petak ujutro kao "potpuno
neutemeljene" spekulacije prenesene u medijima o
tobožnjem hitnom izrucenju bivseg glavnog
urednika Slobodne Dalmacije Josipa Jovica u Haag
mimo procedure predvidjene Ustavnim zakonom o
suradnji s Haskim sudom.

"RH je pravna država u kojoj sudovi sude
temeljem Ustava i zakona te ce se i u predmetu
Jovic, kao i u svim drugim slucajevima dosljedno
primjenjivati odredbe Ustavnog zakona o suradnji
s ICTY-jem", kazao je u petak u Zagrebu pomocnik
ministrice pravosudja zadužen za suradnju s
Haskim sudom.

Jovic je u cetvrtak poslijepodne pritvoren u
Splitu na temelju naloga Haskoga suda, koji ga
je 9. rujna optužio za nepostivanje suda zbog
objave identiteta i iskaza zasticenog svjedoka
sa sudjenja Tihomiru Blaskicu u studenom i
prosincu 2000. godine.

Obzirom da je Jovic unaprijed najavio da ce se
služiti svim pravnim sredstvima u ovom predmetu,
a glasnogovornik Haskog suda Jim Landale pozvao
je na sto hitnije rjesenje ovog slucaja,
Muljacic je kazao kako je Ministarstvo pravosudja
u cetvrtak ujutro poslalo opsirno pismo kojim je
upoznalo tajnika Haskog suda sa svim relevantnim
odredbama Ustavnog zakona i s procedurom pred
hrvatskim sudovima te najavilo da se može
ocekivati da ce postupak pred hrvatskim sudovima
u ovom predmetu trajati nekoliko tjedana.

Zbog slucaja splitskog novinara Josipa Jovica,
Izvrsni odbor Hrvatskog novinarskog drustva
danas je za 17 sati sazvao izvanrednu sjednicu.

Predsjednik HND-a Dragutin Lucic izjavio je Hini
kako je danas o slucaju Jovic razgovarao s
podtajnikom Medjunarodne federacije novinara
Oliverom Money Kyrleom, a vec ranije je o tome
izvijestio i glavnog tajnika Medjunarodne
federacije novinara Aidana Whitea te
predsjednika europske federacije novinara Arnea
Koeniga, zatraživsi pri tome njihovu
interpretaciju cijelog slucaja.

Potpredsjednik HND-a Zdenko Duka misljenja je
kako je Jovic pogrijesio jer se nije odazvao
pozivu Haaskog suda isticuci kako nitko ne može
biti izuzet iz domasaja pravne države.

"Jasno je da ne možemo podržati privodjenje i
pritvaranje jednog novinara zbog toga sto je
objavio, pa makar to bila i objava svjedocenja
zasticenog svjedoka. To je svjedocenje bilo
objavljeno vec i ranije, izjavio je Duka za
danasnji Jutarnji list.

Croatia and Turkey become EU candidates

TURKEY and Croatia officially became the latest European Union candidate countries late last night after a day of knife-edge diplomacy. Following more than 30 hours of torturous negotiations and phone calls from US Secretary of State Condoleezza Rice to Ankara, the way was finally cleared for what should be the first EU member with a Muslim majority. But for Turkey and its population of 70 million it will be a long and winding road with final rejection always a possible outcome while Croatia is almost certain to become the EU’s 28th member by 2010.

Foreign Minister Dermot Ahern said it was a good day for the union. 'It’s important to have Turkey in for the stability and security of Europe and that part of the world,' he said.

Journalist arrested; facing extradition to UN war crimes tribunal
 

New York, October 7, 2005—A Croatian journalist was arrested Thursday and faces extradition to the Hague-based United Nations International Criminal Tribunal for the Former Yugoslavia (ICTY) after being accused of identifying a protected witness and failing to appear at a hearing on a contempt of court charge.

Croatian police in the southern city of Split arrested Josip Jovic, the former editor-in-chief of the Split daily Slobodna Dalmacija, acting on a September 28 arrest warrant issued by the Tribunal, according to local press reports.

Jovic's lawyer Vinko Ljubicic said the journalist was being held at the Split district prison and that "we will submit an appeal as soon as possible," the state news agency HINA reported. The Tribunal issued the arrest warrant after Jovic failed to appear for a September 26 hearing to enter a plea on a contempt of court charge.

The case stems from indictments issued by the Tribunal in April and September against five journalists and a former intelligence officer for identifying a witness who testified against indicted war criminal Tihomir Blaskic in 1997. The Tribunal had issued a number of gag orders barring news organizations from identifying the witness or publishing the witness' testimony. It alleges that the journalists repeatedly defied the gag orders by publishing the identity and testimony.

Four of the journalists have appeared at Tribunal hearings to enter not guilty pleas, saying the material they published was of public interest and the witness' identity had already been made public. Jovic insisted he did nothing wrong and refused to attend a September 26 hearing to enter a plea.

The journalists point out that the protected witness' identity was disclosed in a 1997 Tribunal ruling posted on the Tribunal's Web site. In the 1997 ruling, which was still posted on the site on Friday, the Tribunal identified the witness by name and ruled that the witness' identity should be protected.

The journalists also say that other Croatian media outlets reported the witness' identity. They face up to seven years in prison and 100,000 euros (US$121,000) in fines if found guilty.

The Tribunal unsealed indictments against three of the journalists on April 27. They are: Ivica Marijacic, editor-in-chief of the Zagreb-based weekly Hrvatski List; Stjepan Seselj, publisher of the Zagreb-based weekly Hrvatsko Slovo; and Hrvatsko Slovo editor Domagoj Margetic. The indictments of the two others were unsealed on September 9. They are: Jovic and Marijan Krizic, editor-in-chief of Hrvatsko Slovo.

The journalists were indicted under Rules of Procedure and Evidence 77 A (ii), which authorizes the court to "hold in contempt those who knowingly and willfully interfere with its administration of justice, including any persons who ... disclose information relating to those proceedings in knowing violation of an order of a Chamber."

The Tribunal grants protected witness status to some individuals in an effort to shield them from retaliation for testifying against indicted war criminals. Some protected witnesses have received death threats from supporters of indicted war criminals after being identified in the media.

"Court-imposed gag orders on news organizations are very troubling, and there are unanswered questions about the Tribunal's actions," CPJ Executive Director Ann Cooper said. "For example, it's puzzling why the Tribunal would take legal action against journalists for revealing information that the Tribunal itself has made publicly available. We are closely monitoring how the Tribunal handles these cases."

Journalist arrested at home on the order of the international criminal court for ex-Yugoslavia
Reporters Without Borders called for the release on bail of journalist Josip Jovic, arrested at his Split home on the order of the International Criminal Tribunal for the Former Yugoslavia (ICTY) on a charge of contempt of court.
 

The 6 October 2005 arrest of Jovic, editor of the daily Slobodna Dalmacija was televised and shown the same evening on Croatian TV since he was in process of giving an interview at his home. Jovic’s arrest followed the issue of a warrant by the ICTY signed by a judge at a court in Split. He was placed in custody in a local prison while awaiting extradition to The Hague, which could take several weeks since he plans to appeal to the Croatian constitutional court and the Supreme Court.
 

'We condemn this sudden arrest of Jovic by the Croatian justice system based on a ICTY arrest warrant, which appears disproportionate to the crime he is accused of and sets a dangerous precedent,' the worldwide press freedom organisation said. Considering the mandate of the tribunal in The Hague, which is supposed to try the most serious of international crimes, it is surprising that one of its decisions led to the arrest of a journalist who, even if he did not respect the law, has not committed a crime of violence.'
'The same goes for the four other Croatian journalists also accused of contempt of court. Considering that this journalist represents no danger for Croatia and the ICTY, he should be released on bail.'
 

Jovic failed to appear before the judges in The Hague on 26 September, unlike his colleague Marijan Krizic, editor of the weekly Hrvatsko Slovo, who answered his summons and was allowed to leave the court again freely.
The two journalists are accused of contempt of court, along with Ivica Marijacic, editor of Hrvatski List, Stjepan Seselj, editor of Hrvatsko Slovo, and Domagoj Margetic, editor of Novo Hrvatsko Slovo, for revealing the identity of a protected witnesses, the current Croatian President, Stipe Mesic, at the trial of Tihomir Blaskic in 1997. They face up to seven years in prison and a fine of 100,000 euros.
The trial of Ivica Marijacic, Stjepan Seselj, and Domagoj Margetic, who revealed the identity of Mesic in their newspapers in November 2004, is to open at the end of October.
This confidential information had already been posted on the Documentation and Information Centre Veritas (www.veritas.org.yu) in 1999, and carried by the Bosnian daily Bih Dani, on 1st June 2001.
 

'I will act in solidarity with my colleague and I prefer to go to prison rather than plead guilty before the ICTY', Domagoj Margetic told Reporters Without Borders.
The ICTY chief prosecutor, Carla Del Ponte, said on 4 October that she was in favour of membership talks between Croatia and the EU, since Zagreb was fully cooperating with the ICTY. She had given an unfavourable opinion in March, complaining that the Croatian authorities were dragging their feet in arresting fugitive general, Ante Govina, charged by judges in The Hague in 2001.

JOURNALISTS CAN'T BE BLAMED FOR SOMEONE'S ELSE MISTAKES!

We consider the recent apprehension and the arrest of the Croatian journalist Mr. Josip Jovic, who released and published the names of protected witnesses of the ICTY an extremely discriminatory act against Croatia and its people. We would like to explain to Ms Carla del Ponte that in Croatia there are laws stipulating free speech, freedom of thought and the free media. In case she ignores that, she might better have a look at the similar legislation of her country. The very fact that journalists can find out the name of the protected witness, means that this same witness is not protected at all!
The responsibility for this should not be borne by some "folks of the pen," but rather by the organizational structure of the irresponsible Tribunal itself! Therefore, dear Carla, if somebody needs to be castigated, it should be your secretary, or your colleague from the next door office. And why not blame a custodian of the house or a cleaning lady in the Tribunal who spotted a piece of paper on the floor? Why do you sport so much arrogance and come down on these public figures who report in an unbiased manner about your garishness regarding our martyred, poor and small nation? This act of yours can also be understood as a dictatorial venture and a" ukase" of yours. Croatian World Assembly considers this move of the Hague Tribunal a hypocritical act and detrimental to the internal affairs of  Croatia. As our homeland is teeming with all sorts of crime and banditry, the judiciary (both foreign and domestic) cloth with the garb of "crime" our liberators and our poor journalists. The repressive attitude of the "international " Hague institution, which seems to be more enamored with politics than with justice and ethics, demonstrates with this act that is opposed to free speech on the territory of its much cherished " world province " of Croatia. We are using this opportunity to alert all worthy and honorable members of our people, all our politicians, and especially those who sit at the summit of political power, to reexamine from other perspectives, their own attitudes, their own servile stance
regarding the matter of this imposed task of our cooperation with this institution. If we are not allowed to write and to think, how much "independent" are we? Who will consider us a serious people if we don't consider ourselves serious?
