| Mijenjati na bolje možemo samo prisustvom! Na poziv Dr. Bagarića, idejnog začetnika ovog dokumenta, bio sam prisutan 8. srpnja 2009 na tematskoj sjednici, čije je zaključke usvojio Sabor 10. prosinca 2010, a vlada usvojila Strategiju 5. svibnja 2011. Dakle, radi se o dokumentu koji će se pretočiti u zakon, i tu smo u prilici sugerirati, savjetovati, tražiti i obrazlagati sve što nas tišti, što nam nedostaje, što mozemo poboljšati, pojednostaviti te ubrzati procese sjedinjenja dijaspore i matice domovine. Znam da će mnogi biti skeptični, jer se pokušalo puno puta bez ikakvih rezultata. Ja mislim da si mi ne možemo dozvoliti skepsu, već konkretnim prijedlozima učiniti ovaj budući zakon primjeren i dostojan svih Hrvata i Hrvatica u svijetu. Molim Vas da šaljete Vaše prijedloge i sugestije na ove adrese. Moj savjet je da šaljete na sve adrese, tako da ne bude zabune, je li netko primio ili nije. Budite konkretni i bez puno epike o onome što je bilo a nije funkcioniralo, te osobnim patnjama u papirologiji, jer tu se daju napisati doktorski studiji, a kamo li ne jedno pismo, već konktreno što želite promijeniti. Mi cemo otvoriti i rubriku na Forumu, kako bi se mogle sve Vaše sugestije vidjeti i raspravljati. Mislim da bi i drugi portali trebali to isto preuzeti i razviti u svojim komunama, na svojim jezicima. Svako dobro i na posao, sad je vrijeme! Nenad Bach, urednik CROWNa p.s. | STRATEGIJA O ODNOSIMA REPUBLIKE HRVATSKE S HRVATIMA IZVAN REPUBLIKE HRVATSKE 1. UVOD Republika Hrvatska rezultat je volje hrvatskoga naroda, ostvarena na demokratskim izborima i referendumu te zajedničkim trudom u obrani i izgradnji Republike Hrvatske, kako Hrvata i ostalih građana koji žive u Republici Hrvatskoj, tako i Hrvata izvan Republike Hrvatske. Pod utjecajem različitih povijesnih, političkih i ekonomskih razloga, Hrvati su se stoljećima kontinuirano iseljavali s tadašnjih hrvatskih prostora u susjedne, europske i prekooceanske zemlje u kojima, ovisno o zemlji nastanjenja, imaju različite položaje i statuse. Isto su tako neki dijelovi hrvatskoga naroda, uslijed raznih povijesno-političkih okolnosti, ostali izvan granica Republike Hrvatske, to jest u susjednim državama. Svi Hrvati, bez obzira na to gdje i u kakvom statusu žive, jesu pripadnici jednoga i nedjeljivoga hrvatskog naroda. Hrvati izvan Republike Hrvatske su Hrvati u Bosni i Hercegovini kao ravnopravan, suveren i konstitutivan narod (Hrvati u Bosni i Hercegovini) 1 , pripadnici hrvatskih manjina u europskim zemljama (hrvatske manjine)2, te Hrvati iseljeni u prekooceanske i europske zemlje i njihovi potomci (hrvatsko iseljeništvo/dijaspora)3. Imajući u vidu složenost i političko značenje uređivanja odnosa Republike Hrvatske kao matične države s Hrvatima izvan Republike Hrvatske, Vlada Republike Hrvatske donijela je Odluku o osnivanju Povjerenstva za izradu prijedloga strategije i zakona o odnosima Republike Hrvatske s Hrvatima izvan Republike Hrvatske. 2. POLAZNE OSNOVE Republika Hrvatska nema poseban, jedinstven zakon kojim bi se uredilo pitanje odnosa Republike Hrvatske s Hrvatima izvan Republike Hrvatske, već postoje pojedinačna ili djelomična zakonska i podzakonska rješenja kao i opći i međunarodnopravni instrumenti iz raznih područja kojima se izravno ili neizravno uređuje ovaj odnos. Nadalje, u Republici Hrvatskoj ne postoji posebno tijelo koje bi koordiniralo rad svih državnih institucija koje skrbe o odnosima s Hrvatima izvan Republike Hrvatske, već po pojedinim ministarstvima i institucijama postoje određeni oblici institucionalnih rješenja, odnosno određena praksa u odnosu na Hrvate izvan Republike Hrvatske. U skladu s ovom Strategijom donijet će se novi, posebni zakon, osnovat će se središnje nadležno tijelo i Savjet Vlade te prilagoditi postojeća zakonska rješenja. 1 Prema popisu iz 1991. godine hrvatski narod u Bosni i Hercegovini imao je 760.852 pripadnika (sada oko 400.000). 2 Autohtone hrvatske manjine u 12 europskih zemalja broje oko 350.000 pripadnika. 3 Pod pojmom „hrvatskog iseljeništva“ razumijevaju se iseljeni Hrvati i svi njihovi potomci, odnosno što odgovara značenju pojma „hrvatska dijaspora“ te će se u daljnjem tekstu koristiti pojam „hrvatsko iseljeništvo“. Procjenjuje se da hrvatsko iseljeništvo ima oko 3 milijuna pripadnika, od kojih oko 2 milijuna živi u prekooceanskim zemljama. 2.1. NORMATIVNI OKVIR Ustav Republike Hrvatske (posebno članak 10.) najviši je pravni temelj za izradu Strategije: Republika Hrvatska štiti prava i interese svojih državljana koji žive i borave u inozemstvu i promiče njihove veze s domovinom. Dijelovima hrvatskog naroda u drugim državama jamči se osobita skrb i zaštita Republike Hrvatske. Međunarodnopravni temelj ove Strategije počiva na dvostranim ugovorima Republike Hrvatske s odnosnim zemljama kao i na općim međunarodnopravnim instrumentima 4 , odnosno na priznanju i prihvaćanju neotuđivosti temeljnih ljudskih i građanskih prava, iz kojih se izvodi pravo na zaštitu i očuvanje kulturne raznolikosti te pravo manjinskih zajednica na očuvanje identiteta kroz kulturu i jezik, obrazovanje i informiranje uz punu primjenu načela nemiješanja jedne države u unutarnje poslove druge države. 2.2. STRATEŠKI DOKUMENTI REPUBLIKE HRVATSKE Izrada* ove Strategije također se temelji i u skladu je s razvojnim strateškim dokumentima Republike Hrvatske, a to su: Strateški okvir za razvoj 2006.-2013. koji je Vlada Republike Hrvatske usvojila na sjednici 4. kolovoza 2006. godine.5 Strategija Vladinih programa za razdoblje 2010. – 2012., usvojena na sjednici 10. rujna 2009. godine, a kojom se postavljaju osnovni ciljevi i instrumenti za daljnji socio-ekonomski razvoj Hrvatske.6 Strategija održivog razvitka Republike Hrvatske (Narodne novine, broj 30/2009) koju je donio Hrvatski sabor na sjednici 20. veljače 2009. godine.7 * Izrada ove Strategije prilagođena je uputi Ministarstva financija o izradi strateških planova od 18.03.2009. godine. 4 Instrumenti za zaštitu nacionalnih manjina: -Povelja Ujedinjenih naroda, Opća deklaracija o pravima čovjeka, Međunarodna konvencija o ukidanju svih oblika rasne diskriminacije, Međunarodni pakt o gospodarskim, socijalnim i kulturnim pravima, Deklaracija o ukidanju svih oblika nesnošljivosti i diskriminacije na temelju vjere i vjerovanja, Deklaracija o pravima osoba pripadnika nacionalnih ili etničkih, vjerskih i jezičnih manjina; -Relevantni dokumenti usvojeni od OESS-a, Dokument s Konferencije o ljudskoj dimenziji u Kopenhagenu 1990. godine, Izvješća vladinih stručnjaka za zaštitu manjina, Ženeva 1991. godine; -Europska konvencija za zaštitu ljudskih prava i temeljnih sloboda, Europska povelja o regionalnim ili manjinskim jezicima, Okvirna konvencija za zaštitu nacionalnih manjina i ostali relevantni dokumenti Vijeća Europe; -Instrument Srednjoeuropske inicijative za zaštitu nacionalnih manjina. 5 (…) Strateškim okvirom za razvoj utvrđuju se prioriteti i akcije čije će provođenje tijekom nadolazećih sedam godina osigurati stabilan gospodarski rast, zapošljavanje i bolji životni standard. 6 Isječak iz Strategije Vladinih programa za razdoblje 2010. – 2012.: (…) Vlada Republike Hrvatske posebnim će mjerama poticati hrvatsko iseljeništvo da ulaže u razvoj novih proizvodnji. (…) Razvoj programa financiranja znanstvenih projekata omogućit će (…) privlačenje sposobnih i afirmiranih znanstvenika iz dijaspore i svijeta. (…) Hrvatska će diplomacija u narednom razdoblju raditi na daljnjoj profesionalizaciji i osuvremenjivanju diplomatske mreže koja će još bolje odgovarati potrebama građana u zemlji i inozemstvu, zaštiti svih hrvatskih državljana, kako pojedinaca tako i pripadnika hrvatskih manjina te dijaspore. (…) Hrvatska diplomacija posebnu će pažnju posvetiti primjeni postojećih međunarodnih sporazuma vezanih za raspad bivše Jugoslavije, posebno u području (…) zaštite manjina i zaštite konstitutivnosti hrvatskoga naroda u Bosni i Hercegovini te drugim preuzetim obvezama. 7 (…) Održivi razvitak pretpostavlja ostvarivanje tri opća cilja: stabilnoga gospodarskog razvitka, pravedne raspodjele socijalnih mogućnosti te zaštite okoliša. 3. VIZIJA Republika Hrvatska, ispunjavajući svoje ustavne obveze, trajno ulaže napore u stvaranje pravednoga društva, postizanje održivoga gospodarskog razvoja, te zaštitu prava i interesa svih hrvatskih građana, kako u Republici Hrvatskoj, tako i onih izvan Republike Hrvatske, a dijelovima hrvatskog naroda u drugim državama jamči osobitu skrb i zaštitu. Novi uvjeti, kao što su gospodarski i socijalni razvoj hrvatskoga društva, globalno tržišno gospodarstvo, društvo znanja, socijalna pravda, globalna kretanja te opredjeljenje za euroatlantske integracije, postavljaju pred Republiku Hrvatsku nove izazove i zahtjeve među kojima je i jačanje suradnje s Hrvatima izvan Republike Hrvatske. Republika Hrvatska želi ovom Strategijom djelotvorno povezati cijelo hrvatsko društvo i Hrvate izvan Republike Hrvatske prvenstveno u ostvarivanju hrvatskoga kulturnog zajedništva8, kroz skup kulturnih i drugih društvenih djelatnosti bitnih za očuvanje i jačanje hrvatskoga identiteta i prosperiteta. Hrvati izvan Republike Hrvatske najprirodniji su društveni i kulturni čimbenici u promidžbi i međunarodnoj afirmaciji hrvatskog društva i kulture na europskoj i svjetskoj razini. Ova Strategija je dio strategije razvoja hrvatskog društva i dio je nacionalnog interesa Republike Hrvatske. 4. MISIJA Republika Hrvatska će Strategijom stvoriti pretpostavke za izgradnju učinkovite, djelotvorne i sustavne suradnje Republike Hrvatske s Hrvatima izvan Republike Hrvatske. Strategija i sve što iz nje proizlazi instrument je kojim se utvrđuju načela, ciljevi i aktivnosti državne politike prema Hrvatima izvan Republike Hrvatske. Ona je sastavni dio unutarnje i vanjske politike Republike Hrvatske te skup svih političkih, diplomatskih, gospodarskih, kulturnih, socijalnih, obrazovnih, informacijskih, organizacijskih i drugih mjera i aktivnosti koje provode Predsjednik Republike Hrvatske, Hrvatski sabor i Vlada Republike Hrvatske, kao i druge institucije, radi ostvarenja postavljenih ciljeva. Područja djelovanja Strategije, kroz unutarnju i vanjsku politiku, odnose se na kulturu i umjetnost, očuvanje hrvatskoga jezika, obrazovanje, znanost, školstvo i šport, zdravstvo, gospodarsku i regionalnu suradnju, medije, demografiju i druga područja od interesa. Ovom Strategijom Republika Hrvatska nastoji osigurati primjerene materijalne, društvene i političke uvjete za uspješan razvoj hrvatskoga jezika, kulture i očuvanja hrvatskog identiteta među Hrvatima izvan granica Republike Hrvatske. Republika Hrvatska će kroz uzajamnu suradnju s Hrvatima izvan Republike Hrvatske voditi brigu o materijalnoj i nematerijalnoj kulturnoj baštini Hrvata izvan Republike Hrvatske. Budući da u svijetu postoje različiti položaji hrvatskih zajednica s različitim potrebama i mogućnostima, Republika Hrvatska će sukladno tome prilagoditi svoj pristup svakoj hrvatskoj zajednici poštujući njezine specifičnosti. Republika Hrvatska će u svom odnosu prema Hrvatima izvan Republike Hrvatske imati u vidu da postoje zajednice i pojedinci koji imaju dobar položaj i kvalitetno su integrirani u društvo države u kojoj žive, kao i one zajednice i pojedinci koji nisu 8 Pod pojmom „hrvatskoga kulturnog zajedništva“ podrazumijeva se povezivanje svih Hrvata kako onih u Republici Hrvatskoj tako i onih izvan Republike Hrvatske u smislu najšireg poimanja kulture, kroz jezik i običaje, obrazovanje, znanost, šport, informiranje i druga područja koja su presudna za očuvanje nacionalnog identiteta. odgovarajuće integrirani. Ovisno o tome, Republika Hrvatska će mjere koje poduzima usmjeriti prioritetno ili na očuvanje hrvatskog jezika i kulture, te gospodarsku i svaku drugu naprednu suradnju, ili prema njihovoj zaštiti i pomoći, uključujući i pomoć pri njihovu povratku u Republiku Hrvatsku i integraciji u hrvatsko društvo. Ovim se odnosom namjeravaju jačati hrvatske zajednice izvan Republike Hrvatske i njihov položaj i uloga u sredinama u kojima žive, te osigurati uvjeti za njihovo uključivanje u svekoliki društveni i politički život Republike Hrvatske. Za optimalan razvoj Republike Hrvatske potrebno je uključiti ljudske potencijale svih Hrvata kako onih u Republici Hrvatskoj tako i onih izvan Republike Hrvatske. 5. CILJEVI Temeljni strateški ciljevi su očuvanje, jačanje i razvoj hrvatskoga kulturnog zajedništva te gospodarski i opći napredak, kako Hrvata u Republici Hrvatskoj, tako i Hrvata izvan Republike Hrvatske. Za ostvarivanje ovih strateških ciljeva određeni su sljedeći opći i posebni ciljevi∗. 5.1. USPOSTAVITI NOVI ZAKONODAVNI I INSTITUCIONALNI OKVIR KAO PODLOGU ZA PROVEDBU STRATEGIJE 5.1.1. Izraditi i donijeti Zakon o odnosima Republike Hrvatske s Hrvatima izvan Republike Hrvatske Temeljem Strategije, Vlada Republike Hrvatske će predložiti donošenje Zakona o odnosima Republike Hrvatske s Hrvatima izvan Republike Hrvatske, kojim će se urediti aktivnosti u svezi s ovom Strategijom te osigurati prilagodba tijela državne uprave i Hrvatske matice iseljenika9 kao i postojeće zakonske regulative. 5.1.2. Utemeljiti središnje tijelo nadležno za područje odnosa između Republike Hrvatske i Hrvata izvan Republike Hrvatske Temeljem Strategije i odgovarajućega zakonskog okvira, Vlada Republike Hrvatske će uspostaviti središnje tijelo nadležno za područje odnosa između Republike Hrvatske i Hrvata izvan Republike Hrvatske (dalje: Središnje tijelo), koje će imati ovlasti i odgovornosti glede praćenja i usklađivanja aktivnosti te jačanja veza između tijela državne uprave, Hrvatske matice iseljenika i drugih institucija i udruga u Republici Hrvatskoj s onima Hrvata izvan Republike Hrvatske. Ono će imati ovlasti i odgovornost za osmišljavanje i predlaganje projekata i raznih smjernica rada (provedbene planove), kao i njihove djelotvorne provedbe (financiranje i nadzor) te za vrjednovanje rezultata provedbe ove Strategije. Jednom će godišnje podnositi izvješće o provedbi Strategije i Zakona o odnosima Republike Hrvatske s Hrvatima izvan Republike Hrvatske Hrvatskome saboru. ∗Ciljevi su podijeljeni po skupinama na „opće ciljeve“ (npr. 5.1.) koji se sastoje od podskupina ili „posebnih ciljeva“ (npr. 5.1.2.) kao osnove za stvaranje Zakona. 9 Hrvatska matica iseljenika kao ustanova s najdužom tradicijom djelovanja među iseljeništvom i hrvatskim autohtonim manjinama u europskim zemljama, kao i među hrvatskim narodom u Bosni i Hercegovini, svojim radom i programima nalazi svoje mjesto u provođenju Strategije u području kulture i umjetnosti, očuvanja hrvatskog jezika, obrazovanja i razmjene učenika i studenata, športa, regionalne suradnje, kulturnog turizma, medija kao i ostalih područja. 5.1.3. Utemeljiti Savjet Vlade Republike Hrvatske za Hrvate izvan Republike Hrvatske Temeljem Strategije i odgovarajućega zakonskog okvira, Vlada Republike Hrvatske ustrojit će Savjet Vlade Republike Hrvatske za Hrvate izvan Republike Hrvatske, savjetodavno tijelo koje će pružati pomoć Vladi Republike Hrvatske u kreiranju i provedbi politike, aktivnosti i programa u odnosu na Hrvate izvan Republike Hrvatske. Savjet će najmanje jednom godišnje raspravljati o pitanjima od interesa za Hrvate izvan Republike Hrvatske i o provedbi ove Strategije. Savjet će biti sastavljen od predstavnika udruga, organizacija i institucija iz svih triju grupacija Hrvata izvan Republike Hrvatske, predstavnika državnih tijela i institucija, kao i organizacija civilnoga društva iz Republike Hrvatske. Putem Savjeta Hrvati izvan Republike Hrvatske sudjelovat će u kreiranju politike i programa koji se odnose na Hrvate izvan Republike Hrvatske. Sastav, omjeri i način izbora predstavnika u Savjetu odredit će se Zakonom. 5.2. ŠTITITI PRAVA I INTERESE HRVATA IZVAN REPUBLIKE HRVATSKE TE JAČATI NJIHOVE ZAJEDNICE Republika Hrvatska skrbi za očuvanje nacionalnog identiteta svih naraštaja Hrvata izvan Republike Hrvatske. Interes je Republike Hrvatske suradnja sa svim oblicima organiziranja Hrvata u svijetu (udruge, organizacije, institucije, kulturni centri, hrvatske katoličke misije i dr.) kao i pružanje potpore tim institucijama u svrhu promicanja hrvatskoga jezika, kulture te znanstvene, gospodarske i druge suradnje. Podržavajući ove zajednice Republika Hrvatska pridonosi njihovom razvoju i boljem položaju u zemljama nastanjenja te potiče razvoj unutar hrvatskoga kulturnog zajedništva. Sukladno Strategiji, hrvatska će diplomacija u narednom razdoblju raditi na osuvremenjivanju i prilagodbi diplomatske mreže s ciljem zaštite svih hrvatskih državljana i Hrvata izvan Republike Hrvatske. Posebna će se pažnja posvetiti jačanju njihova položaja i tretmana u Republici Hrvatskoj, što će se očitovati uvođenjem dodatnih pravnih instituta i pogodnosti kao i raznih oblika financijske potpore. Hrvati u Bosni i Hercegovini - Republika Hrvatska skrbi o očuvanju ustavnog položaja Hrvata u Bosni i Hercegovini. Posebnu će pozornost posvetiti provedbi postojećih međunarodnih sporazuma, kao i sklapanju novih, a sve u svrhu opstanka i zaštite hrvatskoga naroda u Bosni i Hercegovini10. Povezivanje s Hrvatima u Bosni i Hercegovini, potpora njihovu povratku i ostanku u Bosni i Hercegovini, te očuvanje njihove pune ravnopravnosti od strateškog su interesa za Republiku Hrvatsku. Isto tako, interes je Republike Hrvatske unaprjeđivati dobrosusjedske odnose s Bosnom i Hercegovinom i podupirati Bosnu i Hercegovinu na putu euroatlantskih integracija. Hrvatske manjine - Republika Hrvatska sustavno brine o statusu hrvatskih manjina u europskim državama i ostvarivanju njihovih manjinskih prava u skladu s međunarodnim pravom. Posebnu će pažnju posvetiti provedbi postojećih međunarodnih dvostranih ugovora za zaštitu hrvatskih manjina. Provodeći postojeće i sklapajući nove dvostrane ugovore, Republika Hrvatska će tražiti ispunjenje standarda i uvažavanje uzajamnosti, kako bi se osigurao opstanak i zaštitila prava za 10 Razmjerno prijeratnom broju svojih pripadnika hrvatski je narod u Bosni i Hercegovini pretrpio najveća stradanja od agresije na Bosnu i Hercegovinu i etničkog čišćenja. Procjenjuje se da je samo s prostora entiteta „Republike Srpske“ protjerano oko 220.000 Hrvata. hrvatske nacionalne manjine u europskim zemljama kakva uživaju nacionalne manjine u Republici Hrvatskoj.11 Hrvatsko iseljeništvo - Područje skrbi za hrvatske iseljenike, među ostalim, obuhvaća očuvanje nacionalnog identiteta svih naraštaja hrvatskih iseljenika te jačanje raznih oblika odnosa (političkih, gospodarskih i kulturnih) između iseljene i domovinske Hrvatske. Hrvatima izvan Republike Hrvatske koji žive u teškim gospodarskim i političkim uvjetima u državama u koje su se iselili, Republika Hrvatska će pružati zaštitu i pomoć do uključivo i pomoć pri povratku u Republiku Hrvatsku i integraciju u hrvatsko društvo, sukladno svojim mogućnostima. 5.2.1. Jačati položaj Hrvata izvan Republike Hrvatske Ubrzati primitak u hrvatsko državljanstvo - U skladu sa Zakonom o hrvatskom državljanstvu (Narodne novine, br. 53/91, 70/91, 28/92, 113/93 i 4/94) i njegovim potrebnim izmjenama, Republika Hrvatska će pri podnošenju i rješavanju zahtjeva pojednostaviti, olakšati i ubrzati primitak u hrvatsko državljanstvo Hrvatima izvan Republike Hrvatske i njihovim potomcima. Pritom će se uzimati u obzir i izjašnjavanje pripadnosti hrvatskome narodu u državi u kojoj žive (npr. posebni birački popisi nacionalnih manjina). Uvesti status Hrvata bez hrvatskog državljanstva - Kako bi se postigao zaokret u odnosu na trendove asimilacije dijelova hrvatskih zajednica u svijetu, potrebno je stvoriti novi administrativni okvir unutar kojega bi postojali preduvjeti za povezivanje Republike Hrvatske i onih Hrvata koji nemaju hrvatsko državljanstvo. Stoga će Republika Hrvatska Zakonom i kroz propisanu proceduru uvesti status Hrvata bez hrvatskog državljanstva, kao zalog za opstanak hrvatskih zajednica izvan Republike Hrvatske, a posebno onih koje žive u zemljama gdje nije dozvoljeno dvojno državljanstvo. Isti status mogu steći i supružnici bez hrvatskih korijena te prijatelji hrvatskog naroda i Republike Hrvatske koji očituju želju za hrvatskim identitetom i sudjeluju u promicanju hrvatskoga kulturnog zajedništva. One osobe kojima će biti odobren status Hrvata bez hrvatskog državljanstva uživat će u Republici Hrvatskoj pravo na jednostavnije upisne uvjete u školskim i visokoškolskim ustanovama, pravo stjecanja vlasništva nad nekretninama12, mogućnost kandidiranja za slobodna radna mjesta, pravo prijave na određene natječaje i stipendije iz dotičnih područja kao i natječaje za financijsku potporu hrvatskim zajednicama izvan Republike Hrvatske, povoljnije uvjete za stjecanje viza, odobrenje privremenog boravka, te radne i poslovne dozvole. Uvesti pogodnosti za Hrvate bez hrvatskog državljanstva i bez gore navedenog statusa - U skladu sa Zakonom o strancima (Narodne novine, br. 79/2007 i 36/2009) i njegovim potrebnim izmjenama, pripadnicima hrvatskoga naroda bez hrvatskog državljanstva i bez statusa, Republika Hrvatska će pojednostaviti i ubrzati postupak dobivanja vize, stjecanja privremenog boravka, te radne i poslovne dozvole. Isto tako će omogućiti pravo prijave na određene natječaje i stipendije iz područja obrazovanja i kulture. Osigurati olakšice prilikom turističkih boravaka u Republici Hrvatskoj – Republika Hrvatska će u suradnji sa zainteresiranim institucijama i gospodarskim subjektima uvesti tzv. „Hrvatsku karticu“ („CRO Card“) koja će Hrvatima izvan Republike Hrvatske omogućiti povoljniji pristup određenim uslugama, prilikom turističkih posjeta, putovanja, boravka i sudjelovanja na kulturnim događanjima, a u svrhu razvoja projekta Republike Hrvatske kao turističkog odredišta. 11 Ustavni zakon o pravima nacionalnih manjina jamči visoku razinu prava nacionalnim manjinama u Republici Hrvatskoj. U Strategiji Vladinih programa za razdoblje 2010.– 2012. ističe se također da Republika Hrvatska omogućava ostvarivanje prava svih nacionalnih manjina u Republici Hrvatskoj te da su osigurane zakonske pretpostavke za punu primjenu Ustavnog zakona o pravima nacionalnih manjina. 12 Odnosi se uglavnom na pripadnike hrvatskoga naroda koji žive u prekooceanskim zemljama, s obzirom da od 1. veljače 2009. državljani i pravne osobe iz zemalja Europske unije mogu u Republici Hrvatskoj kupovati nekretnine bez ikakvih posebnih uvjeta. Naime, isti uvjeti koji za kupovinu nekretnine vrijede za hrvatske državljane vrijede i za njih, osim kad je u pitanju stjecanje poljoprivrednog zemljišta i zaštićenih dijelova prirode. 5.2.2. Očuvati hrvatski jezik, kulturu i identitet među Hrvatima izvan Republike Hrvatske Očuvati hrvatski jezik - Republika Hrvatska omogućit će dijelu Hrvata izvan Republike Hrvatske besplatno učenje i studiranje početnih semestara hrvatskog jezika u Republici Hrvatskoj te će poticati pohađanje hrvatske nastave u inozemstvu. Primjenom e-obrazovanja, kao potpore nastavi hrvatskoga jezika i kulture u inozemstvu, unaprijedit će se dostupnost i kvaliteta učenja hrvatskog jezika. Republika Hrvatska će poticati osnivanje lektorata hrvatskog jezika i književnosti na stranim visokim učilištima kao i utemeljenje katedri za hrvatski jezik na sveučilištima u inozemstvu. Očuvati hrvatsku kulturu i identitet - Imajući za cilj osigurati opstanak hrvatskih zajednica izvan Republike Hrvatske, Republika Hrvatska će podupirati sve oblike njihovog organiziranja kojima se promiče i čuva identitet i kultura. Sukladno tome financijski će se podupirati programi i projekti, ovih oblika organiziranja hrvatskog naroda u Bosni i Hercegovini, hrvatskih manjina u europskim zemljama te hrvatskog iseljeništva/dijaspore. Posebno će se osigurati odgovarajuća sredstva za stipendiranje učenika i studenata u njihovim lokalnim sredinama i u Republici Hrvatskoj, a sve u svrhu unaprjeđenja znanja i intelektualnih potencijala njihovih zajednica. 5.2.3. Poticati hrvatske zajednice izvan Republike Hrvatske na uključivanje u lokalni društveni i politički život U interesu je Republike Hrvatske trajno ojačati položaj hrvatskih zajednica izvan Republike Hrvatske kao mosta suradnje između država u kojima žive i Republike Hrvatske. Posebno će podupirati pripadnike hrvatskoga naroda u ostvarivanju njihovih prava kroz promicanje suradnje s lokalnim institucijama i tijelima zemalja nastanjenja, te poticati interkulturni dijalog. 5.2.4. Aktivno uključivati Hrvate izvan Republike Hrvatske u društveni i politički život Republike Hrvatske Uključivanje Hrvata izvan Republike Hrvatske u društveni i politički život Republike Hrvatske bitna je pretpostavka za stvaranje čvršćih veza te međusobnog uvažavanja i razumijevanja na svim društvenim područjima. Republika Hrvatska osigurava zastupljenost Hrvata izvan Republike Hrvatske u Hrvatskome saboru te ih na taj način uključuje u politički život Republike Hrvatske i podupire ostvarenje njihovih prava i interesa. Nadalje, Hrvati izvan Republike Hrvatske će kroz Savjet Vlade Republike Hrvatske za Hrvate izvan Republike Hrvatske sudjelovati u kreiranju politike, aktivnosti i programa koji se odnose na Hrvate izvan Republike Hrvatske. Isto tako će zainteresirane institucije, udruge i građani moći predlagati svojega kandidata u Programsko vijeće Hrvatske radiotelevizije, sukladno Zakonu o HRT-u (Narodne novine br. 137/2010), s ciljem prilagodbe radijskoga i televizijskog programa i javnih radiodifuzijskih usluga od interesa za Hrvate izvan Republike Hrvatske. Za jačanje odnosa s Hrvatima izvan Republike Hrvatske, Republika Hrvatska će utemeljiti i obilježavati „Dan Hrvata izvan Republike Hrvatske“. 5.2.5. Jačati hrvatske zajednice putem informiranja i povezivanja Obostrana informiranost i jačanje veza između Republike Hrvatske i Hrvata izvan Republike Hrvatske je preduvjet kulturne, gospodarske i svake druge suradnje. Sredstva informiranja Središnjeg tijela i srodnih institucija, te javni mediji i internetske tehnologije imat će presudnu važnost u povezivanju i komunikaciji Republike Hrvatske s Hrvatima izvan Republike Hrvatske. Informiranje putem Središnjeg tijela - Središnje tijelo informirat će Hrvate izvan Republike Hrvatske i javnost putem svojih internetskih stranica te prikladnih publikacija kao i neposrednom komunikacijom. Središnje će tijelo putem glasnogovornika osigurati distribuciju potrebnih informacija medijima u Republici Hrvatskoj i medijima Hrvata izvan Republike Hrvatske. Povezivanje svih tijela državne uprave kao i lokalne i područne (regionalne) samouprave - Zbog djelotvornog informiranja Hrvata izvan Republike Hrvatske, Središnje tijelo oformit će administrativno-komunikacijsku mrežu između državnih tijela, Hrvatske matice iseljenika, kao i drugih institucija u Republici Hrvatskoj, uključujući diplomatske misije i konzularne urede Republike Hrvatske, kao prvih administrativnih sugovornika Republike Hrvatske s Hrvatima izvan Republike Hrvatske. Mediji - Hrvatska radiotelevizija, kao javna ustanova, temeljem svojih zakonskih obveza izradit će plan i program rada radijskih i televizijskih emisija, termina emitiranja, te ih prilagoditi potrebama Hrvata izvan Republike Hrvatske, a u skladu s ciljevima ove Strategije. 5.3. RAZVIJATI SURADNJU S HRVATIMA IZVAN REPUBLIKE HRVATSKE S ciljem jačanja i razvoja suradnje s pojedincima, udrugama i institucijama Hrvata izvan Republike Hrvatske u okviru hrvatskoga kulturnog zajedništva, Republika Hrvatska će u skladu s ovom Strategijom i svojom vanjskom politikom, kroz nadležna tijela, razvijati i podupirati suradnju na području kulture, obrazovanja, znanosti, športa, gospodarstva, politike, kao i na drugim područjima. 5.3.1. Kulturna suradnja Uz već spomenute mjere i aktivnosti na jačanju zajednica Hrvata izvan Republike Hrvatske na području kulture, Republika Hrvatska će nadograđivati ovaj odnos kroz poticanje povezivanja udruga i kulturnih institucija iz Republike Hrvatske s udrugama i institucijama Hrvata izvan Republike Hrvatske i istih međusobno. Republika Hrvatska će također poticati razmjenu hrvatskoga kulturnog stvaralaštva i baštine nastale u lokalnim zajednicama Hrvata izvan Republike Hrvatske s Republikom Hrvatskom. Republika Hrvatska će kroz uzajamnu suradnju poticati uspostavu hrvatskih kulturnih instituta/centara u zemljama s hrvatskim zajednicama. 5.3.2. Obrazovna i znanstvena suradnja Uz već spomenute mjere i aktivnosti na jačanju zajednica Hrvata izvan Republike Hrvatske na području obrazovanja i znanosti, Republika Hrvatska će nadograđivati ovaj odnos kroz povezivanje domaćih obrazovnih i znanstvenih institucija i pojedinaca s hrvatskim udrugama, institucijama i pojedincima izvan Republike Hrvatske, a sve s ciljem obostrane suradnje i korištenja potencijala hrvatskih znanstvenika i stručnjaka. Projektom se želi ujediniti hrvatski znanstveni i stručni potencijal u domovini i svijetu u izgradnji društva utemeljenog na znanju kao jednoga od ključnih čimbenika društvenoga i gospodarskog razvoja Republike Hrvatske. Središnje tijelo će poticati umrežavanje hrvatskih sveučilištaraca izvan Republike Hrvatske. 5.3.3. Gospodarska suradnja Interes je Republike Hrvatske surađivati i povezivati se sa svim zemljama svijeta, a osobito s onima u kojima žive hrvatske zajednice. Hrvati koji žive u tim zemljama mogu u tome imati vrlo važnu ulogu. Republika Hrvatska će u duhu ove Strategije i Strategije održivog razvitka Republike Hrvatske unaprjeđivati poslovne veze s Hrvatima izvan Republike Hrvatske, a posebnim će mjerama poticati hrvatsko iseljeništvo na ulaganje i proizvodnju u Republici Hrvatskoj. Radi stjecanja novih tržišta i promicanja hrvatskih proizvoda i usluga, Republika Hrvatska će s ciljem izvoza poticati suradnju s hrvatskim gospodarstvenicima u svijetu. Isto tako u suradnji s hrvatskim gospodarstvenicima izvan Republike Hrvatske posebno će kreirati razvojne projekte na manje razvijenim područjima ili područjima od posebne državne skrbi. U suradnji s Ministarstvom gospodarstva, rada i poduzetništva, Hrvatskom gospodarskom komorom, Hrvatskom obrtničkom komorom i hrvatskom gospodarskom diplomacijom, Središnje tijelo poticat će povezivanje hrvatskih gospodarstvenika i gospodarskih komora u inozemstvu. Kao oblik gospodarske suradnje s Hrvatima u susjednim i okolnim zemljama, Republika Hrvatska će poticati regionalnu/prekograničnu suradnju kroz pomoć pri kandidiranju na natječajima za fondove Europske unije, te će poticati prilagodbu postojećih i osnivanje odgovarajućih gospodarskih i financijskih institucija (fondacija i mikro kreditiranja) kao oblika financiranja. Sustavno vođenje posebnih evidencija i statistika - Kao preduvjet praćenja stanja gospodarskih odnosa i ulaganja u Republici Hrvatskoj, Hrvata izvan Republike Hrvatske te poticanja na međusobnu suradnju, potrebno je: - sastaviti adresar hrvatskih gospodarstvenika u svijetu te adresar hrvatskih gospodarstvenika povratnika i useljenika, - sastaviti evidencije o ulaganjima Hrvata izvan Republike Hrvatske te o ulaganju hrvatskih povratnika i useljenika, - sastaviti evidencije novčanih doznaka Hrvata izvan Republike Hrvatske, - pratiti vanjsko-trgovinske bilance sa zemljama nastanjenja Hrvata izvan Republike Hrvatske, - pri kupnji ili registraciji gospodarskog subjekta u Republici Hrvatskoj evidentirati ako je vlasnik ili osnivač Hrvat izvan Republike Hrvatske, kao povratnik ili vanjski ulagač. Kako se u Republici Hrvatskoj ne vode navedeni posebni adresari i evidencije, Republika Hrvatska će pristupiti potrebnim prilagodbama zakonodavstva u nadležnim tijelima i institucijama te ih učiniti dostupnima Središnjem tijelu, a sukladno Zakonu o zaštiti osobnih podataka (Narodne novine, br. 103/2003, 118/2006 i 41/2008). 5.3.4. Poticati znanstveno-istraživački rad na temu hrvatskih migracija Republika Hrvatska će poticati istraživanje hrvatskog iseljeništva, hrvatskih manjina u inozemstvu i Hrvata u Bosni i Hercegovini te utemeljiti dokumentacijski centar i muzej za povijesne dokumente i izdavaštvo Hrvata izvan Republike Hrvatske. Znanstveno-istraživački rad na temu hrvatskih migracija, poticat će se u suradnji sa znanstvenicima iz iseljeništva, u svrhu izrade vjerodostojnog prikaza uzroka iseljavanja, kvalitativnih i kvantitativnih obilježja vanjskih migracija te procjene raspoloženja i uvjeta za povratak. Državni zavod za statistiku pratit će i prikupljati podatke o Hrvatima izvan Republike Hrvatske, kao i o hrvatskim povratnicima i useljenicima u suradnji s nadležnim tijelima Republike Hrvatske i inozemnim državnim zavodima za statistiku. 5.4. POTICATI POVRATAK HRVATSKIH ISELJENIKA I NJIHOVIH POTOMAKA U REPUBLIKU HRVATSKU Demografska obnova je uvjet opstanka hrvatskoga naroda te je jedan od prioriteta hrvatske politike redefiniranja useljeničke politike Republike Hrvatske. Među mjere demografske obnove i razvitka spadaju i one čiji je cilj povratak hrvatskih iseljenika i useljavanje njihovih potomaka te istodobno smanjenje iseljavanja iz Republike Hrvatske. Uređivanjem useljeničke politike s jasnim ciljevima promicanja humanih, socijalnih, demografskih, kulturnih i gospodarskih interesa, povratak hrvatskih iseljenika i njihovih potomaka po uzoru na druge imigracijske zemlje postat će prioritet. Hrvatima koji su u iseljeništvu stekli znanje, vještine i iskustvo, radi ostvarivanja zajedničkih interesa, Republika Hrvatska želi osigurati uvjete održivog povratka. Razvoj strategije naseljavanja slabo naseljenih područja Republike Hrvatske sastavni je dio ove Strategije. Carinske i porezne povlastice - Republika Hrvatska će, sukladno Strategiji, pružati carinske olakšice pri uvozu predmeta kućanstva i gospodarskog inventara kod doseljenja u Republiku Hrvatsku. Uvest će se također posebne porezne povlastice za hrvatske povratnike/useljenike, fizičke i pravne osobe, pri njihovom nastanjenju i stupanju u poslovni odnos u Republici Hrvatskoj. Programi za brzu integraciju - Uza sve navedene programe za brzu integraciju u Republici Hrvatskoj13, Središnje tijelo uvest će program praćenja putem „mentora/savjetnika“ koji će kroz optimalno vrijeme pratiti proces integracije doseljenika i ostvarivanja njihovih prava. 5.4.1. Privlačiti afirmirane znanstvenike Sukladno Strategiji Vladinih programa za razdoblje 2010. – 2012., Vlada Republike Hrvatske će razvojem programa financiranja znanstvenih projekata omogućavati i daljnje privlačenje sposobnih i afirmiranih znanstvenika hrvatskog podrijetla iz svijeta. Poticat će se povratak i suradnja s hrvatskim znanstvenicima izvan Republike Hrvatske kroz znanstvene projekte i istraživanja. Uspostavit će se stalni program „virtualnog mentorstva“ između studenata i znanstvenika s hrvatskim znanstvenicima i gospodarstvenicima u svijetu s ciljem transfera posebnih znanja i iskustva (know-how). 5.4.2. Privlačiti učenike i studente Republika Hrvatska provodi programe učenja hrvatskog jezika u Republici Hrvatskoj, stipendira učenike i studente hrvatskog podrijetla koji se školuju ili pohađaju visoka učilišta u Republici Hrvatskoj, te pritom pomaže pri njihovu smještaju u đačke i studentske domove. 13 učenje hrvatskoga jezika, stipendije za učenike i studente, razne olakšice, itd. Poticat će se sveučilišta na donošenje upisnih kvota za Hrvate izvan Republike Hrvatske, kako bi se pojednostavio i ubrzao postupak upisivanja na visokoškolske ustanove. Prava po pitanju školarina, smještaja i prehrane, u potpunosti će se izjednačiti s pravima učenika i studenata iz Republike Hrvatske. Poticat će se približavanje Republike Hrvatske mladima u iseljeništvu putem osmišljenih programa dolaska u Republiku Hrvatsku. Ovi programi obuhvaćaju škole hrvatskoga jezika za sve uzraste, različite kulturne i obrazovne programe, stručnu praksu kao i sezonski rad učenika i studenata. Poticat će se hrvatske obrazovne institucije na osmišljavanje i podupiranje projekata „razmjene“ učenika i studenata na temelju uzajamnosti. 5.4.3. Ostvarivati projekte zapošljavanja hrvatskih povratnika u skladu s potrebama tržišta rada Hrvatski zavod za zapošljavanje će u skladu s ovom Strategijom osigurati dostupnost strukturiranih evidencija o potrebama tržišta rada u Republici Hrvatskoj, a putem Središnjeg tijela i diplomatske mreže osigurat će se prosljeđivanje tih informacija Hrvatima izvan Republike Hrvatske. Ministarstvo gospodarstva, rada i poduzetništva će u suradnji s Hrvatskim zavodom za zapošljavanje osmišljavati i ostvarivati projekte zapošljavanja hrvatskih povratnika i useljenika u skladu s potrebama i mogućnostima Republike Hrvatske i u skladu s ciljevima Strategije. 5.4.4. Olakšati povratak umirovljenika i drugih osoba Republika Hrvatska će kroz sklopljene i preuzete međunarodne ugovore o socijalnom osiguranju te potrebnim izmjenama u pripadajućim zakonima provoditi modele rješavanja prava iz mirovinskog i zdravstvenog osiguranja za povratnike i useljenike. Poticat će se pregovori o međunarodnim ugovorima o socijalnom osiguranju sa zemljama s kojima Republika Hrvatska nema sklopljene dvostrane ugovore ili unaprjeđenje postojećih ugovora. Isto tako Republika Hrvatska će, kroz diplomatsko-konzularnu mrežu, pratiti stanja zajednica i pojedinaca koji nisu odgovarajuće integrirani u zemljama u kojima žive te će ih po potrebi i određenim kriterijima štititi i pomagati im do uključivo pružanja pomoći pri povratku u Republiku Hrvatsku i integracije u hrvatsko društvo. 6. PROVEDBA STRATEGIJE I FINANCIJSKA IZDVAJANJA 6.1. PROVEDBA STRATEGIJE Provedba ove Strategije obvezna je za sva tijela državne uprave koja izravno ili neizravno provode aktivnosti vezane za Hrvate izvan Republike Hrvatske. Strategija će se provoditi putem zakona i podzakonskih akata te po potrebi akcijskim planovima14. Obveza je nadležnih tijela dostavljati redovna izvješća o provedbi ove Strategije Središnjem tijelu koje koordinira aktivnosti i područja odnosa između Republike Hrvatske i Hrvata izvan Republike Hrvatske. Središnje tijelo koordinirat će i nadzirati provedbu Strategije i relevantnih zakonskih propisa te će redovita godišnja izvješća o provedbi dostavljati Hrvatskome saboru. 14 Akcijski planovi bi sadržavali opise pojedinih zadaća sa svrhom, ciljevima, aktivnostima, planiranim rezultatima, pokazateljima (indikatorima), nositeljima aktivnosti, korisnicima, rokovima, financijskim i drugim sredstvima te izvorima sredstava potrebnih za njihovu provedbu. 6.2. FINANCIJSKA IZDVAJANJA Za provedbu ove Strategije bit će osigurana sredstva iz državnog proračuna u okviru limita ukupnih rashoda koje Vlada Republike Hrvatske utvrđuje smjernicama ekonomske i fiskalne politike. Provedbu ove Strategije moguće je dijelom financirati i iz drugih izvora (donacija i sl.). Pri davanju financijske pomoći Republika Hrvatska će pridavati važnost tome da primatelji djeluju u skladu s temeljnim načelima Ustava Republike Hrvatske i da se poštuje ravnoteža između potpore države i samostalnog financiranja. Financijsku pomoć mogu primati i čimbenici koji u Republici Hrvatskoj djeluju na području povezivanja i brige za Hrvate izvan Republike Hrvatske. Sastavni dio provođenja financijske potpore Republike Hrvatske je razvijanje planiranog djelovanja, praćenje učinaka i nadzor nad potrošenim sredstvima. 6.3. PRIJELAZNE ODREDBE Po donošenju Strategije i Zakona o odnosima Republike Hrvatske s Hrvatima izvan Republike Hrvatske, cilj 5.1. Uspostaviti novi zakonodavni i institucionalni okvir kao podlogu za provedbu Strategije smatrat će se ispunjenim, te će se daljnje aktivnosti usmjeravati prema ostvarenju preostalih ciljeva ove Strategije: 5.2. | Vlada: strategija o Hrvatima izvan domovine ZAGREB, 5. svibnja 2011.(Hina) - Strategijom o odnosima Republike Hrvatske s Hrvatima izvan Republike Hrvatske, koju je Vlada prihvatila na današnjoj sjednici, predviđa se donošenje novog, jedinstvenog zakona kojim će se urediti to pitanje, kao i osnivanje Savjeta Vlade te Središnjeg nadležnog tijela za to područje. Time se, kazao je potpredsjednik Vlade i ministar vanjskih poslova Gordan Jandroković, po prvi put sustavno želi urediti odnos s Hrvatima izvan Hrvatske, a što je i ustavna obveza države. Strategija definira tri skupine Hrvata izvan RH - Hrvate u BiH, pripadnike hrvatskih manjina u europskim zemljama (hrvatske manjine) te Hrvate iseljene u prekooceanskim i europskim zemljama (Hrvatsko iseljeništvo/dijaspora), a za svaku je skupinu predviđen poseban plan djelovanja i aktivnosti. "Osnovni cilj je jačanje hrvatskih zajednica u njihovim zemljama nastanjenja i jačanje veza prema Hrvatskoj uređenjem međusobnih i partnerskih odnosa na svim poljima od obostranog interesa te stvaranje uvjeta za održivi povratak", kazao je Jandroković. Jačanje položaja Hrvata izvan RH, prema strategiji, predviđeno je, uz ostalo, ubrzanim primitkom u hrvatsko državljanstvo te uvođenjem statusa Hrvata bez hrvatskog državljanstva kako bi se očuvale hrvatske zajednice, posebno one u zemljama gdje nije dozvoljeno dvojno državljanstvo. Prema strategiji, taj bi status mogli steći i supružnici bez hrvatskih korijena te prijatelji hrvatskog naroda i RH koji očituju želju za hrvatskim identitetom i sudjeluju u promicanju hrvatskog kulturnog zajedništva. Strategija predviđa i omogućavanje pogodnosti poput lakšeg dobivanja viza i radnih i poslovnih dozvola, kao i osiguravanje olakšica prilikom turističkih boravaka u Hrvatskoj kroz uvođenje tzv. "Hrvatske kartice" (CRO Card) koja bi Hrvatima izvan domovine omogućila povoljniji pristup određenim uslugama prilikom boravka u Hrvatskoj, a u svrhu razvoja Hrvatske kao turističkog odredišta. "Hrvatska želi ovom strategijom djelotvorno povezati cijelo hrvatsko društvo i Hrvate izvan RH, prvenstveno u ostvarivanju hrvatskog kulturnog zajedništva, što podrazumijeva kulturno, obrazovno, gospodarsko i drugo povezivanje Hrvata s matičnom državom kako bi se osnažio i očuvao hrvatski jezik, identitet i prosperitet", naglasio je Jandroković. |

17. lipanj 2011 Predsjednica Vlade Republike Hrvatske Jadranka Kosor sastala se danas u Banskim dvorima s kardinalom Vinkom Puljićem, nadbiskupom vrhbosanskim, i banjolučkim biskupom Franjom Komaricom. Kardinal Puljić i biskup Komarica zahvalili su predsjednici Vlade na izradi Strategije o odnosima Republike Hrvatske s Hrvatima izvan Republike Hrvatske i istaknuli potrebu što skorijeg donošenja zakona koji će provesti mjere iz Strategije. To će, kako su kazali, donijeti novi prostor za bolju suradnju, posebno na gospodarskom planu. Hrvati u BiH u iznimno su teškoj situaciji, bez infrastrukture, bez radnih mjesta, a nerijetko i bez temeljnih ljudskih prava, što je osnova za ravnopravnost u BiH. Pomagati Hrvatima u Bosni i Hercegovini naša je Ustavna obveza, rekla je predsjednica Vlade i dodala da će završetkom svojih pregovora za ulazak u Europsku uniju Hrvatska dobiti novu poziciju u odnosu na BiH, što će se pozitivno odraziti na potporu Hrvatima u toj zemlji. Predsjednica Vlade Jadranka Kosor istaknula je i kako je spomenuti Zakon o odnosima RH s Hrvatima izvan RH u izradi te da će do kraja ljetnog zasjedanja ući u saborsku proceduru. Kardinal Puljić i biskup Komarica pozvali su predsjednicu Vlade da posjeti Bosnu i Hercegovinu te da otvori 8. gospodarski forum u organizaciji Caritasa i Udruge Hrvata „Prsten“. |
STRATEGY FOR THE RELATIONS BETWEEN THE REPUBLIC OF CROATIA AND THE CROATIANS OUTSIDE THE REPUBLIC OF CROATIA
| STRATEGY FOR THE RELATIONS BETWEEN THE REPUBLIC OF CROATIA AND THE CROATIANS OUTSIDE THE REPUBLIC OF CROATIA 1. INTRODUCTION The Republic of Croatia is the result of the will of the Croatian people, established in the democratic election and the referendum, and through the joint effort in defending and building of the Republic of Croatia by both Croatians and other citizens living in the Republic of Croatia and the Croatians living outside the Republic of Croatia. For different historical, political and economic reasons, throughout centuries, the Croatians continued to emigrate from the then Croatian lands to the neighbouring, European and overseas countries where, depending on the specific country, they now have different positions and status. Parts of the Croatian people, due to various historical and political circumstances, remain outside the borders of the Republic of Croatia, i.e. in the neighbouring states. All the Croatians, no matter where they live and what status they enjoy, belong to one indivisible Croatian nation. The Croatians outside the Republic of Croatia include: the Croatians in Bosnia and Herzegovina as an equal, sovereign and constituent people (Croatians in Bosnia and Herzegovina)1, members of the Croatian minorities in European countries (Croatian minorities)2, and the Croatians who emigrated overseas and to European countries and their offspring (Croatian emigrants/diaspora)3. Bearing in mind the complexity and political importance of regulating the relation between the Republic of Croatia as their mother state with the Croatians outside the Republic of Croatia, the Government of the Republic of Croatia has passed the Decision on Establishing a Commission to Prepare Draft Strategy and Law on the Relations between the Republic of Croatia and the Croatians outside the Republic of Croatia. 2. BASIC FOUNDATIONS The Republic of Croatia has no specific, integral law regulating the relation between the Republic of Croatia and the Croatians outside the Republic of Croatia, there are only separate or partial laws or by-laws and the general international law instruments in different areas that directly or indirectly apply to this relation. Furthermore, in the Republic of Croatia there is no separate authority that would coordinate the operation of all the state institutions that take care of the relation with the Croatians outside the Republic of Croatia. There are rather some forms of institutional solutions at individual ministries and authorities, i.e. there is certain practice in dealing with the Croatians outside the Republic of Croatia. 1 According to the 1991 census, the Croatian population in Bosnia and Herzegovina was more than 760,852 (presently, about 400,000). 2 Autochtonous Croatian minorities in 12 European countries number about 350,000 members. 3 The term „Croatian emigants“ includes Croatians who emigrated and all their offspring, i.e. its corresponds with the meaning of the term „Croatian diaspora“, and hereinafter, the term „Croatian emigrants“ will be used. It is estimated that the Croatian emigrants include about 3 million members, of whom about 2 million live overseas. 2 In accordance with this Strategy, a new specific law will be passed, a central authority in charge will be established as well as a consultative Government Council, and the existing legal solutions will be adjusted accordingly. 2.1. NORMATIVE FRAMEWORK The Constitution of the Republic of Croatia (specifically Article 10) is the highest legal foundation for the development of the Strategy: The Republic of Croatia shall protect the rights and interests of its citizens who live and stay abroad and shall promote their ties to their home country. Parts of the Croatian people in other states shall be guaranteed special care and protection by the Republic of Croatia. The international law foundation of this Strategy lies in the bilateral agreements between the Republic of Croatia and the relevant countries as well as in the general international law instruments4, i.e. the recognition and inalienability of the basic human and civil rights, from which derives the right to the protection and preservation of cultural variety and the right of minority communities to preserve their identity in culture and language, education and information, with the full implementation of the principle of non-interference between states. 2.2. STRATEGIC DOCUMENTS OF THE REPUBLIC OF CROATIA The development* of this Strategy is also based on and in conformity with the strategic development documents of the Republic of Croatia: Strategic Development Framework 2006-2013, adopted by the Government of the Republic of Croatia at its meeting on 4 August 2006.5 Strategy of Government Programs 2010 – 2012, adopted at the meeting on 10 September 2009, setting the main goals and instruments for further social and economic development of Croatia.6 Strategy of Sustainable Development of the Republic of Croatia (Official Gazette of the Republic of Croatia 30/2009) adopted by the Croatian Parliament at its meeting on 20 February2009.7 * The development of this Strategy was harmonised with the instruction of the Ministry of Finance concerning the development of strategic plans (18.03.2009). 4 Instruments for the protection of national minorities: -UN Charter, General Declaration of the Rights of Man, International Convention on the Abolishment of All Forms of Racial Discrimination, International Pact on Economic, Social and Cultural Rights, Declaration on the Elimination of All Forms of Intolerance and of Discrimination Based on Religion or Belief, Declaration on the Rights of Persons Belonging to National or Ethnic, Religious and Linguistic Minorities; -Relevant documents adopted by the OSCE, the Document of the Conference on Human Dimension, Copenhagen, 1990, Reports of Government Experts on Minority Protection, Geneva, 1991; -European Convention for the Protection of Human Rights and Fundamental Freedoms, European Charter for Regional and Minority Languages, Framework Convention for the Protection of National Minorities and other relevant documents of the Council of Europe; -Instrument of the Central European Initiative for the Protection of National Minorities. 5 (…) The Strategic Development Framework determines the priorities and activities the implementation of which in the next seven years will secure stable growth, employment and better standard of living. 6 Extract from the Strategy of Government Programs 2010 – 2012: (…) The Government of the Republic of Croatia will by means of specific measures encourage Croatian emigrants to invest in the development of new production. (…) The development of the program to fund scientific projects will enable (…) attracting capable and affirmed scientists from the diaspora and the world. (…) In the next period, Croatian diplomats will work on further professionalisation and modernisation of the diplomatic network to even better suit the needs of the citizens at home and abroad, to protect all the Croatian citizens both individual persons and members of the Croatian minorities and the diaspora. (…) Croatian diplomats will pay special attention to the implementation of the existing agreements related to the dissolution of the former Yugoslavia, particularly as concerns (…) the protection of minorities and the protection of the constituent character of the Croatian people in Bosnia and Herzegovina, and other commitments assumed. 7 (…) Sustainable development assumes the realisation of three general goals: stable economic development, just distribution of social opportunities and environmental protection. 3 3. VISION The Republic of Croatia, in meeting its constitutional obligations, constantly makes effort to develop just society, to achieve sustainable economic development, and to protect the rights and interests of all the Croatian citizens, both in the Republic of Croatia and outside it, and to guarantee special care and protection to parts of the Croatian people in other states. New conditions such as the economic and social development of Croatian society, the global market economy, knowledge society, social justice, global developments and commitment to Euro-Atlantic integration, place new challenges before the Republic of Croatia as well as new demands that include the reinforcement of cooperation with the Croatians outside the Republic of Croatia. With this Strategy the Republic of Croatia wants to effectively bring together the entire Croatian society and the Croatians outside the Republic of Croatia primarily through the realisation of the Croatian cultural unity8 through a number of cultural and other social activities relevant to the preservation and strengthening Croatian identity and prosperity. The Croatians outside the Republic of Croatia are the most natural social and cultural factors in the promotion and international affirmation of Croatian society and culture on the European and global levels. This Strategy is part of the strategy for the development of Croatian society and is of the national interest to the Republic of Croatia. 4. MISSION With this Strategy the Republic of Croatia will create conditions for building effective and systematic cooperation between the Republic of Croatia and the Croatians outside the Republic of Croatia. The Strategy and all things related constitute a means to determine the principles, goals and activities of the national policy towards the Croatians outside the Republic of Croatia. It is integral part of the home and foreign policies of the Republic of Croatia and a collection of all the political, diplomatic, economic, cultural, social, educational, information, organisational and other measures and activities implemented by the President of the Republic of Croatia, the Croatian Parliament and the Government of the Republic of Croatia, as well as many other institutions, in order to achieve the goals set. Areas of activity within the home and foreign policies regulated in the Strategy include culture and art, preservation of the Croatian language, science, education and sport, health care, economic and regional cooperation, the media, demography and other areas of interest. With this Strategy the Republic of Croatia is trying to create appropriate materials, social and political conditions for the successful development of the Croatian language and culture and the preservation of the Croatian identity of the Croatians outside the borders of the Republic of Croatia. The Republic of Croatia will in cooperation with the Croatians outside the Republic of Croatia take care of the material and immaterial cultural heritage of the Croatians outside the Republic of Croatia. Since the Croatian communities throughout the world find themselves in varying positions and have different needs and possibilities, the Republic of Croatia will adjust its approach to every single 8 „Croatian cultural unity“ implies the bringing together all the Croatians, both in the Republic of Croatia and outside the Republic of Croatia in the broadest sense of culture, language and customs, education, science, sport, information and other areas essential to preserving the national identity. 4 Croatian community accordingly, respecting its specific situation. The Republic of Croatia will in its relation with the Croatians outside the Republic of Croatia bear in mind that there are communities and individuals with a good position who are well integrated in the society of the state in which they live, as well as that there are communities and individuals who are not adequately integrated. Accordingly, the Republic of Croatia will prioritize the measures to undertake either by focusing on the preservation of the Croatian language and culture, and the economic and any other advanced cooperation, or on protecting and supporting them, including the assistance in returning to the Republic of Croatia and integrating in Croatian society. This Strategy intends to strengthen Croatian communities outside the Republic of Croatia and their position and role in the settings where they live, and to create conditions for their inclusion in the general social and political life of the Republic of Croatia. For the optimum development of the Republic of Croatia it is necessary to include all the human resources of all the Croatians, the ones in the Republic of Croatia and the ones outside the Republic of Croatia. 5. GOALS The basic strategic goals are the preservation, strengthening and development of the Croatian cultural unity and the economic and general progress, both of the Croatians in the Republic of Croatia and of the Croatians outside the Republic of Croatia. To achieve this, the following general and specific goals have been set∗. 5.1. PUTTING IN PLACE A NEW LEGISLATIVE AND INSTITUTIONAL FRAMEWORK AS THE BASIS FOR THE IMPLEMENTATION OF THE STRATEGY 5.1.1. Prepare and pass the Law on Relations between the Republic of Croatia and the Croatians outside the Republic of Croatia On the basis of the Strategy, the Government of the Republic of Croatia will propose the adoption of the Law on the Relations between the Republic of Croatia and the Croatians outside the Republic of Croatia to regulate the activitiesincluded in this Strategy and ensure the adjustment of the state administrative bodies and the Croatian Emigrants Association9 as well as the existing legislation. 5.1.2. Establish a central authority in charge of the relations between the Republic of Croatia and the Croatians outside the Republic of Croatia On the basis of the Strategy and the appropriate legal framework, the Government of the Republic of Croatia will set up a central authority in charge of the relations between the Republic of Croatia and the Croatians outside the Republic of Croatia (hereinafter: the Central Authority) that will have the powers and responsibility to monitor and coordinatr the activities and strengthen the ties between the state administrative bodies, the Croatian Emigrants Association and other ∗The goals are divided into groups as „general goals“ (e.g. 5.1.) that include sub-groups or „specific goals“ (e.g. 5.1.2.) that constitute the basis for the development of the Law. 9 The Croatian Emigrants Association as the institutionn with the longest tradition among the emigrants and autochtonous Croatian minorities in the European countries, and among the Croatian people in Bosnia and Herzegovina, with its operation and programs has its place in the implementation of the Strategy in the areas of culture and art, the preservation of the Croatian language, the education and exchange of pupils and students, sport, regional cooperation, culture tourism, the media etc. 5 authorities and associations in the Republic of Croatia with the Croatians outside the Republic of Croatia. It will have the powers and responsibility to develop and propose projects and guidelines (implementation plans) and to iplement them effectively (funding and supervision) as well as to evaluate the results of the implementation of the Strategy. Once a year it will submit a report to the Croatian Parliament on the implementation of the Strategy and the Law on the Relations between the Republic of Croatia and the Croatians outside the Republic of Croatia. 5.1.3. Establish the Council of the Government of the Republic of Croatia for the Croatians outside the Republic of Croatia On the basis of the Strategy and the appropriate legal framework, the Government of the Republic of Croatia will set up the Council of the Government of the Republic of Croatia for the Croatians outside the Republic of Croatia, a consulting body to support the Government of the Republic of Croatia in creating and implementing the policy, the activities and programs concerning the Croatians outside the Republic of Croatia. The Council will at least once a year discuss matters of the interest to the Croatians outside the Republic of Croatia and the implementation of the Strategy. The Council will include representatives of the associations, organizations and institutions of all the three groups of the Croatians outside the Republic of Croatia, representatives of state authorities and institutions, as well as representatives of the civil society from the Republic of Croatia. Through the Council the Croatians outside the Republic of Croatia will participate in the creation of the policy and programs concerning them. The composition, ratio and election of representatives to the Council will be determined in the Law. 5.2. PROTECT THE RIGHTS AND INTERESTS OF THE CROATIANS OUTSIDE THE REPUBLIC OF CROATIA AND STRENGTHEN THEIR COMMUNITIES The Republic of Croatia cares for the preservation of the national identity of all the generations of the Croatians outside the Republic of Croatia. It is the interest of the Republic of Croatia to cooperate with all the forms of organization of the Croatians world-wide (associations, organizations, institutions, cultural centres, Croatian Catholic missions etc.) as well as to support any such institutions with a view to promoting the Croatian language, cultural and scientific, economic and other cooperation. In supporting these communities the Republic of Croatia contributes to their development and better position in the countries where they live and encourages their development within the framework of the Croatian cultural unity. In the next period, Croatian diplomats will work in accordance with the Strategy to modernize and adjust the diplomatic network with a view to protecting all the Croatian citizens and Croatians living outside the Republic of Croatia. Special attention will be devoted to strengthening their position and treatment when in the Republic of Croatia, which will be reflected in the introduction of additional legal institutes and facilities and various forms of financial support. Croatians in Bosnia and Herzegovina – The Republic of Croatia cares for the preservation of the constitutional status of the Croatians in Bosnia and Herzegovina. Special attention will be devoted 6 to the implementation of the existing international agreements and the conclusion of new ones, for the sake of the survival and protection of the Croatian people in Bosnia and Herzegovina10. The connection with the Croatians in Bosnia and Herzegovina, the support for their return and stay in Bosnia and Herzegovina, and the preservation of their full equality, are of the strategic interest to the Republic of Croatia. Likewise, it is the interest of the Republic of Croatia to nurture good neighbourly relations with Bosnia and Herzegovina and to support Bosnia and Herzegovina on its path to Euro-Atlantic integration. Croatian minorities – The Republic of Croatia systematically cares for the status of the Croatian national minorities in the European states and the exercise of their minority rights in accordance with international law. Special attention will be devoted to the implementation of the existing bilateral agreements for the protection of the Croatian minorities. In implementing the existing and concluding new bilateral agreements, the Republic of Croatia will seek that the standards be met and reciprocity respected in order to secure the survival and protect the rights of the Croatian national minorities in the European countries as are enjoyed by the national minorities in the Republic of Croatia.11 Croatian emigrants – Care for the Croatian emigrants includes among other things the preservation of the national identity of all the generations of the Croatian emigrants and strengthening various facets of relations (political, economic and cultural) between the Croatian emigrants and the Croatian population in the Republic of Croatia. The Croatians outside the Republic of Croatia who live in difficult economic and political circumstances in the states to which they emigrated will be provided protection and assistance by the Republic of Croatia, including the assistance to return to the Republic of Croatia and integrate into Croatian society, in accordance with the means available. 5.2.1. Strengthen the status of the Croatians outside the Republic of Croatia Speed up admission to Croatian citizenship – In accordance with the Law on Croatian Citizenship (Official Gazette of the Republic of Croatia 53/91, 70/91, 28/92, 113/93 and 4/94) and its necessary amendments, the Republic of Croatia will in the submission and processing of applications simplify, facilitate and speed up admission to Croatian citizenship for the Croatians outside the Republic of Croatia and their offspring. In this, their declaration as belonging to the Croatian people in the states where they live (e.g. separate lists of the voters of national minorities) will be taken into account. Introduce the status of the Croatians without Croatian citizenship – In order to achieve a turnabout in regard of the assimilation trends affecting some Croatian communities throughout the world, it is necessary to create a new administrative framework within which conditions would be created to connect the Republic of Croatia and the Croatians who do not have Croatian citizenship. The Republic of Croatia will, therefore, in its Law and the prescribed procedure introduce the status of the Croatians without Croatian citizenship, as a guarantee of the survival of the Croatian communities outside the Republic of Croatia, particularly those living in the countries where no dual citizenship is allowed. The same status may be acquired by their spouses without Croatian roots and by the friends of the Croatian people and the Republic of Croatia who express their desire to have the Croatian identity and participate in the promotion of the Croatian cultural unity. The persons accorded the status of the Croatians without Croatian citizenship will be entitled to simpler enrolment requirements at the schools and colleges/universities in the Republic of 10 In proportion to their pre-war numbers, the Croatian population in Bosnia and Herzegovina suffered the most during the aggression against Bosnia and Herzegovina and the ethnic cleansing. It is estimated that from the area of the „Republic of Srpska“ alone about 220,000 Croatians were driven away. 11 The Constitutional Law on the Rights of National Minorities guarantees a high level of rights to the national minorities in the Republic of Croatia. In the Strategy of the Government Programs 2010–2012 it is also noted that the Republic of Croatia enables the exercise of the rights of all the national minorities in the Republic of Croatia and that all the legal conditions have been created for the full implementation of the Constitutional Law on the Rights of the National Minorities. 7 Croatia, to the acquisition of real property12, they will have the opportunity to apply for jobs, to participate in specific competitions and receive scholarships, as well as to apply for financial support for the Croatian communities outside the Republic of Croatia, enjoying more favourable requirements for obtaining visas, temporary stay approval, and work and business permits, respectively. Introduce facilities for the Croatians without Croatian citizenship even without the above-mentioned status – In accordance with the Law on Aliens (Official Gazette of the Republic of Croatia 79/2007 and 36/2009) and its necessary amendments, for the members of the Croatian people without Croatian citizenship and the appropriate status, the Republic of Croatia will simplify and speed up the procedure for obtaining a visa, temporary stay, and work and business permits. It will also make available to them specific competitions and scholarships in education and culture. Provide facilities for tourist stays in the Republic of Croatia – The Republic of Croatia will, in cooperation with the interested institutions and business entities introduce the so-called „CRO Card“ that will enable the Croatians outside the Republic of Croatia to more easily access particular services on their tourist visits, journeys, stays and participation in cultural events, with a view to developing the project of the Republic of Croatia as a tourist destination. 5.2.2. Preserve the Croatian language, culture and identity among the Croatians outside the Republic of Croatia Preserve the Croatian language – The Republic of Croatia will enable the Croatians outside the Republic of Croatia to learn the Croatian language and attend the entry-level semesters in the study of the Croatian language in the Republic of Croatia free of charge, and it will encourage attendance of the Croatian classes in foreign countries. Through e-learning in support of the Croatian language classes in foreign countries it will also improve the accessibility and quality of learning Croatian. The Republic of Croatia will encourage the establishment of a lectorship for the Croatian language and literature at foreign colleges and universities as well as the establishment of Croatian departments at universities in foreign countries. Preserve the Croatian culture and identity – Aiming to ensure the survival of the Croatian communities outside the Republic of Croatia, the Republic of Croatia will support all the forms of their organisation to promote and preserve their identity and culture. Accordingly, it will financially support the programs and projects of such forms of organisations of the Croatian people in Bosnia and Herzegovina, Croatian minorities in the European countries, and the Croatian emigrants/diaspora. Appropriate funds for scholarship for pupils and students will be separately provided in their local communities and in the Republic of Croatia, with a view to improving the knowledge and the intellectual potentials of their communities. 5.2.3. Encourage Croatian communities outside the Republic of Croatia to participate in the local social and political life It is in the interest of the Republic of Croatia to permanently strengthen the status of the Croatian communities outside the Republic of Croatia as a bridge for cooperation between the states in which they live and the Republic of Croatia. It will particularly support the Croatians in the exercise of their rights through the promotion of cooperation with the local institutions and authorities in the countries in which they live, and the encouragement of the intercultural dialogue. 12 Applies mostly to the members of the Croatian people living overseas, considering that since 1 February 2009 the citizens and legal persons from the EU Member States may acquire real property in the Republic of Croatia without any special conditions. Notably, the same conditions that apply to Croatian citizens acquiring real property are also applicable to them, except in case of the acquisition of farming land and protected areas of nature. 8 5.2.4. Actively include the Croatians outside the Republic of Croatia in the social and political life of the Republic of Croatia The inclusion of the Croatians outside the Republic of Croatia in the social and political life of the Republic of Croatia is an important prerequisite to creating closer ties and mutual respect and understanding in all social areas. The Republic of Croatia ensures the representation of the Croatians outside the Republic of Croatia in the Croatian Parliament and thus includes them in the political life of the Republic of Croatia and supports the exercise of their rights and interests. Furthermore, through the Council of the Government of the Republic of Croatia the Croatians outside the Republic of Croatia will participate in the creation of the policy, activities and programs concerning them. The interested institutions, associations and individuals will also be able to propose their candidates to the Program Council of the Croatian Radio and Television in conformity with the CRT Act (Official Gazette of the Republic of Croatia 137/2010), with a view to harmonising the radio and television programs and broadcasting services of the interest to the Croatians outside the Republic of Croatia. In order to strengthen the relations with the Croatians outside the Republic of Croatia, the Republic of Croatia will establish and celebrate the „Day of the Croatians outside the Republic of Croatia“. 5.2.5. Strengthen Croatian communities through information and connection Mutual information and strengthening the ties between the Republic of Croatia and the Croatians outside the Republic of Croatia are the prerequisites to the cultural, economic and any other cooperation. The bulletins of the Central Authority and related institutions, and the public media and the Internet technologies will be of the key importance in the Republic of Croatia connecting to and communicating with the Croatians outside the Republic of Croatia. Information through the Central Authority – The Central Authority will inform the Croatians outside the Republic of Croatia and the public through its website and appropriate publications and through direct communication. The Central Authority will have a spokesperson to provide the necessary information for the media in the Republic of Croatia and to the media of the Croatians outside the Republic of Croatia. Connecting all the state administrative bodes and the local and regional self-government – For the sake of effective information of the Croatians outside the Republic of Croatia, the Central Authority will develop an administrative and communication network among the state bodies, the Croatian Emigrants Association and other institutions in the Republic of Croatia, including the diplomatic missions and consular posts of the Republic of Croatia, as the first administrative contact points of the Republic of Croatia in the relation with the Croatians outside the Republic of Croatia. Media – Croatian Radio and Television, as a public institution, pursuant to its legal obligations, will prepare the plan and program of the operation of the radio and television shows, the broadcasting schedule, and will make allowances for the needs of the Croatians outside the Republic of Croatia, in conformity with the goals set in this Strategy. 9 5.3. DEVELOP COOPERATION WITH THE CROATIANS OUTSIDE THE REPUBLIC OF CROATIA With a view to strengthening and developing cooperation with individuals, associations and institutions of the Croatians outside the Republic of Croatia within the framework of the Croatian cultural unity, the Republic of Croatia will, in accordance with this Strategy and its foreign policy, through the authorities in charge, develop and support the cooperation in culture, education, science, sport, business, politics etc.. 5.3.1. Cultural cooperation With the already mentioned measures and activities to strengthen the communities of the Croatians outside the Republic of Croatia in culture, the Republic of Croatia will improve on this relation through connecting the associations and cultural institutions from the Republic of Croatia with the associations and institutions of the Croatians outside the Republic of Croatia, and among themselves. The Republic of Croatia will also encourage the exchange of the Croatian cultural activities and heritage created in the local communities between the Croatians outside the Republic of Croatia and the Republic of Croatia. The Republic of Croatia will, through mutual cooperation encourage the establishment of the Croatian culture institutes/centres in the countries where Croatian communities live. 5.3.2. Educational and scientific cooperation In addition to the already mentioned measures and activities in strengthening the communities of the Croatians outside the Republic of Croatia in education and science, the Republic of Croatia will improve on this relation through connecting the domestic educational and scientific institutions and individuals with the Croatian associations, institutions and individuals outside the Republic of Croatia for the sake of the mutual cooperation and utilisation of the potentials of the Croatian scientists and experts. The project is focused on uniting the Croatian scientific and professional potentials at home and abroad in order to build the knowledge society as one of the key factors in the social and economic development of the Republic of Croatia. The Central Authority will encourage the networking of the Croatian alumni outside the Republic of Croatia. 5.3.3. Economic cooperation It is the interest of the Republic of Croatia to cooperate and connect with all the countries of the world, particularly those where Croatian communities live. The Croatians living in such countries can play a very important role in this. In the spirit of this Strategy and the Sustainable Development Strategy, the Republic of Croatia will advance its relations with the Croatians outside the Republic of Croatia, and special measures will be put in place to encourage the Croatian emigrants to invest and produce in the Republic of Croatia. In order to acquire new markets and promote Croatian products and services the Republic of Croatia will encourage cooperation with Croatian businessmen world-wide to boost its exports. In cooperation with Croatian businessmen outside the Republic of Croatia it will specifically create development projects for underdeveloped areas or areas of special government concern. 10 In cooperation with the Ministry for Economic Affairs, Labour and Entrepreneurship, the Croatian Chamber of Commerce, the Croatian Chamber of Trades, and the Croatian commercial diplomats, the Central Authority will encourage connections between Croatian businessmen and foreign Chambers of Commerce. As a form of the economic cooperation with the Croatians in the neighbouring and surrounding countries, the Republic of Croatia will encourage regional/transborder cooperation through its assistance in applying for the funds of the European Union, and will encourage the adjustment of the existing and the establishment of the appropriate economic and financial institutions (foundations and micro loans) as financing form. Systematically keeping specific records and statistics – As a prerequisite to monitoring the status of the economic ties and investment in the Republic of Croatia by the Croatians outside the Republic of Croatia, and to encouraging mutual cooperation, it is necessary to: - Prepare an address book of Croatian businessmen in the world and the address book of returned and immigrated Croatian businessmen, - Prepare records about the investment of the Croatians outside the Republic of Croatia and about the investment by Croatian returnees and immigrants, - Prepare records about the cash remittances of the Croatians outside the Republic of Croatia, - Monitor the foreign trade balance with the countries where the Croatians outside the Republic of Croatia live, - In the acquisition or registration of a business entity in the Republic of Croatia make a note when the owner or founder is a Croatian outside the Republic of Croatia, being a returnee or an external investor. In the Republic of Croatia the above-mentioned records and address books are presently not kept, so the Republic of Croatia will see to the necessary amendments to the legislation by the authorities and institutions in chargem making them available to the Central Authority in conformity with the Law on Personal data Protection (Official Gazette 103/2003, 118/2006 and 41/2008). 5.3.4. Encourage scientific research into Croatian migrations The Republic of Croatia will encourage research into the Croatian emigrants, Croatian minorities in foreign countries and the Croatians in Bosnia and Herzegovina, and establish a documentary centre and museum for the historical documents and publications of the Croatians outside the Republic of Croatia. Scientific research on the subject of Croatian migrations will be supported in cooperation with expatriate scientists, in order to prepare an authentic presentation of the causes of the emigration, qualitative and quantitative characteristics of the external migrations and the evaluation of the mindset and conditions for a return. The State Bureau of Statistics will monitor and collect the information about the Croatians outside the Republic of Croatia, as well as about Croatian returnees and immigrants in cooperation with the authorities in charge in the Republic of Croatia and foreign state bureaus of statistics. 5.4. ENCOURAGE THE RETURN OF CROATIAN EMIGRANTS AND THEIR OFFSPRING TO THE REPUBLIC OF CROATIA Demographic renewal is the condition of survival of the Croatian nation and it is one of the priorities of the Croatian policy in redefining the immigration policy of the Republic of Croatia. The measures for the demographic renewal and development also include the ones aiming at the 11 return of Croatian emigrants and the immigration of their offspring, with the simultaneous reduction in the emigration from the Republic of Croatia. In regulating the immigration policy with the clear goals to promote humane, social, demographic, cultural and economic interests, the return of the Croatian emigrants and their offspring modelled on other immigration countries will become a priority. To materialize our joint interests, the Republic of Croatia wants to create conditions for the sustainable return of the Croatians who have acquired the knowledge, skills and experience abroad. Developing a strategy to populate the sparsely populated areas of the Republic of Croatia is integral part of this Strategy. Customs and tax reliefs – The Republic of Croatia will, in accordance with the Strategy, provide customs reliefs in importing household items and business inventory on immigrating to the Republic of Croatia. There will also be special tax reliefs for Croatian returnees/immigrants, natural and legal persons, upon their taking up residence and engaging in business in the Republic of Croatia. Programs for quicker integration – In addition to all the mentioned programs for quick integration in the Republic of Croatia13, the Central Authority will also introduce the program of monitoring through „mentors/counsellors“ who will monitor the process of integration of the immigrants and the exercise of their rights for a specified period of time. 5.4.1. Attract established scientists Pursuant to the Strategy of Government Programs 2010 – 2012, the Government of the Republic of Croatia will through the development of the program for funding scientific projects make it possible to further attract capable and established scientists of the Croatian origin from all over the world. It will encourage the return of and cooperation with Croatian scientists outside the Republic of Croatia in scientific research projects. A permanent program of „virtual mentorship“ between the students and teachers and Croatian scientists and businessmen world-wide will be put in place with a view to transferring the necessary knowhow. 5.4.2. Attract pupils and students The Republic of Croatia is conducting programs for Croatian language teaching in Croatia, awards scholarships to pupils and students of the Croatian origin who go to school or study in the Republic of Croatia, and assists with their accommodation in pupils or student homes. Universities will be encouraged to determine enrolment quotas for the Croatians outside the Republic of Croatia in order to simplify and speed up the enrolment in colleges and universities. The rights concerning the school fees, board and lodgings will be fully equalized with the rights of the pupils and students from the Republic of Croatia. The Republic of Croatia will be encouraged to approach the young emigrants through the programs developed for their visit to the Republic of Croatia. These programs include Croatian language schools for all age groups, various cultural and educational programs, the professional practice and seasonal work of pupils and students. Croatian educational institutions will be encouraged to develop and support the projects of pupils and student exchange based on reciprocity. 13 Learning Croatian, scholarships for pupils and students, various facilities etc. 12 5.4.3. Realize projects for the employment of Croatian returnees in accordance with the needs of the labour market In accordance with this Strategy the Croatian Employment Office will ensure availability of structured records about the labour market demand in the Republic of Croatia, and the Central Authority and the diplomatic network will ensure that this information is passed on to the Croatians outside the Republic of Croatia. The Ministry for Economic Affairs, Labour and Entrepreneurship will, in cooperation with the Croatian Employment Office, develop and conduct projects for the employment of Croatian returnees and immigrants in accordance with the needs and possibilities of the Republic of Croatia and in accordance with the goals of the Strategy. 5.4.4. Facilitate the return of the retired and other persons Through the international social security agreements concluded and taken over and the necessary amendments to the relevant legislation, the Republic of Croatia will implement models for the exercise of the rights from the pension and health insurance of the returnees and immigrants. It will encourage negotiations on international social security agreements with the countries with which the Republic of Croatia has no bilateral agreements, or on the improvement of the existing agreements. Through its diplomatic and consular network the Republic of Croatia will also monitor the status of the communities and individuals who are not adequately integrated in the countries where they live, and when necessary it will protect and assist them under specific terms including the assistance to return to the Republic of Croatia and integrate in Croatian society. 6. IMPLEMENTATION AND FUNDING OF THE STRATEGY 6.1. IMPLEMENTATION The implementation of this Strategy is obligatory for all the state administrative bodies that directly or indirectly conduct activities related to the Croatians outside the Republic of Croatia. The Strategy will be implemented in accordance with laws and by-laws and, when necessary, in accordance with action plans14. The authorities in charge are obliged to submit regular reports on the implementation of the Strategy to the Central Authority that coordinates the activities and areas of relations between the Republic of Croatia and the Croatians outside the Republic of Croatia. The Central Authority will coordinate and monitor the implementation of the Strategy and the relevant legislation, submitting regular annual reports to the Croatian Parliament. 6.2. FUNDING For the implementation of this Strategy funds will be allocated from the national budget within the limits of the total expenditures that the Government of the Republic of Croatia determines in the guidelines of the economic and fiscal policies. The implementation of this Strategy can partly be funded from other sources (donations etc.). In providing financial assistance the Republic of Croatia will attach importance to the fact that the beneficiaries should act in 14 Action plans would include descriptions of particular tasks with their purposes, goals, activities, results planned, indicators, facilitators, beneficiaries, schedule, funds and other means and the sources of funds necessary for their implementation. 13 accordance with the basic principles of the Constitution of the Republic of Croatia and that the balance between the state support and own funding be respected. Financials assistance may also be received by the factors that are active in the Republic of Croatia in connecting and caring for the Croatians outside the Republic of Croatia. The implementation of the financial support of the Republic of Croatia includes the development of planned activities, monitoring the effects and controlling the spending. 6.3. TRANSITIONAL PROVISIONS Upon the adoption of the Strategy and the Law on the Relations between the Republic of Croatia and the Croatians outside the Republic of Croatia, goal 5.1. Put in place a new legislative and institutional framework as the basis for the implementation of the Strategy will be considered fulfilled, and further activities will be directed towards the realization of the remaining goals of the Strategy: 5.2. Protect the rights and interests of the Croatians outside the Republic of Croatia and strengthen their communities, 5.3.
